Types of GoodsÂ
The Lifeguard-Pro Home-Study Course offered and delivered byÂ Lifeguarding Classes LLCÂ is a non-tangible good (digital academic testing program) offered only online. The In-Person Training Sessions are services provided directly byÂ Lifeguarding Classes LLC.Â Lifeguarding Classes LLCÂ is an authorized provider of Lifeguard-Pro trainings.
The Home-Study Course, and all copyrighted, proprietary and valuable materials contained therein are deemed delivered to the buyer onceÂ Lifeguarding Classes LLCÂ emails or otherwise provides the buyer with the buyerâ€™s purchased Username & Password to access the contents of the Home-Study Course.Â
In-Person Training sessions are provided at the location, date and time reserved in writing (email) by the customer and approved in writing (email) byÂ Lifeguarding Classes LLCÂ and/or the In-Person Training Instructor.Â The In-Person Training Session is deemed to be fully delivered, when the In-Person Training Instructor arrives at the reserved location on the reserved date and time, and the In-Person Training Instructor conducts the In-Person Training Session that the customer purchased. It is the customerâ€™s sole responsibility to ensure that all of the customerâ€™s Lifeguard-Pro certification course candidates participate in the purchased In-Person Training Session. If one or more of the customerâ€™s Lifeguard-Pro certification candidateâ€™s fail to participate in the purchased In-Person Training Session at the reserved location on the reserved date and time, neither the customer nor the candidate(s) are entitled to any refund or rescheduled In-Person Training Session. The customer and/or candidate(s) that failed to attend the purchased In-Person Training Session at the reserved location on the reserved date and time may request the In-Person Training Instructor to conduct an additional In-Person Training Session for an additional fee to which the customer and/or candidate(s), and the In-Person Training Instructor agree.Â
Once the buyer uses their purchased Username & Password to login to Lifeguard-Pro to access the Lifeguard-Pro Home-Study Course to view, use or access the Home-Study Course or any of the contained copyrighted, proprietary or valuable materials contained therein, the buyer is no longer entitled to any refund from Lifeguard-Pro orÂ Lifeguarding Classes LLC. No refund can be issued because copyrighted, proprietary and valuable materials are held to market value and worth.Â Once the buyer has read, viewed, used or accessed the copyrighted, proprietary and/or valuable materials contained in the Home-Study Course, Lifeguard-Pro cannot reclaim that value it provided to the buyer. Consequently, Lifeguard-Pro and/orÂ Lifeguarding Classes LLCÂ cannot issue any refunds to the buyer once the buyer logs into the Lifeguard-Pro Home-Study Course using their purchased Username & Password.
Because there are travel, administrative, and other costs associated with an In-Person Training Instructor traveling to the customerâ€™s reserved location on the reserved date and time, and conducting the purchased In-Person Training Session, neither a customer nor candidate(s) are entitled to any refund nor rescheduling of the In-Person Training Session.
Incompatible Software or HardwareÂ
Lifeguard-Pro and/orÂ Lifeguarding Classes LLCÂ do not bear any responsibility and therefore will not grant any refund, return or exchange requests based on incompatibility of our products with the buyerâ€™s computer, tablet or cellphone. Buyerâ€™s might install some third-party software (plug-ins, add-ons, modules, search engines, scripts, extensions, firewalls, anti-virus programs, less popular browsers, etc) which can interfere with the operation of the Lifeguard-Pro Home-Study Course. Our Home-Study Course is designed to function properly on Apple desktop/laptop computers and Microsoft desktop/laptop using as an internet browser, Chrome, Firefox or Internet Explorer. We do not guarantee that our Home-Study Course is fully compatible with any other third-party programs, software or computers, and we do not provide support for third-party applications or hardware. However, as a courtesy, if you have a hardware or software problem accessing your purchased Lifeguard-Pro Home-Study Course, you may contact our Technical Support Department (TechSupport@Lifeguard-Pro.org) for assistance; but, their assistance on third-party software or hardware issues is purely a courtesy and provided with no guarantees.
Right to CureÂ
The customer agrees to email all customer product complaints to our Technical Support Department at TechSupport@Lifeguard-Pro.org before initiating any chargeback and afford Lifeguard-Pro 14 calendar days to repair or replace the product. To provide expeditious product delivery, Lifeguard-Pro may deliver the repaired or replaced product to the customer via email attachment or valid download link.Â Our Technical Support Department is always eager to assist you and deliver professional support in a timely manner
If a class is cancelled due to severe weather, instructor illness/injury, family emergencies or any unexpected emergency, registered students will receive priority enrollment in the next available class.
REGISTRATION AND ATTENDANCE POLICIES:
Once a class is purchased, the home-study link along with username and password is typically emailed to the participant within 5-7 business days. Once the home-study is successfully completed, the in-person session is typically scheduled with 5-10 business days. If you have a deadline, we work with you in an attempt to meet your deadline. However, we are unable to guarantee that your class can be completed any faster than the timeline listed above in this subsection.
Students who do not attend a scheduled class session are NOT ELIGIBLE FOR A REFUND. Special exceptions may be considered on a case-by-case basis.
Student Retake Policy
If a student fails a class (skills check, written test or online portion), no certificate will be provided. NO REFUNDS WILL BE PROVIDED. The student has the option of taking the class again at 50% of the cost.
All students/participants must purchase hard copy manuals or utilize electronic manuals.
Students registered for full, in-person classes must arrive on time and be present for the entire class to receive a certification. Students arriving more than 15 (fifteen) minutes late may be denied entry. All classes and skills check sessions only have a 5-minute grace period. After 5-minutes, students will be denied entry and will have to reschedule their class and/or skills check session and MUST purchase said session again.
Refresher/Recertification/Review Course Policy
If you are a new student or have a certification card that HAS expired more than 30 days ago, you must take the full certification class. If you have a current, NON-EXPIRED or expired within 30 days, certification card, you are eligible to take the recertification course. You must present your current certification card to your instructor at your first in-person session.
Defined terms under this Agreement:
â€œMinorsâ€ â€“ shall mean the following minors who are the children, foster children, wards or otherwise legal responsibility of the Participants.
â€œReleased Partiesâ€ â€“ shall mean Lifeguarding Classes LLC and its subsidiaries and parent companies and each of the above-named partiesâ€™ partners, officers, directors, committee chairpersons, committee members, agents, management company(s), contractors, employees, servants, successors or assigns.
â€œSwimming Poolâ€ â€“ shall mean the swimming pool being used for the â€œParticipantsâ€ hands-on skills session which may be located any place in the United States and its Territories, Canada, England, Ireland, Nevis, St. Kittâ€™s, Bahamas, Aruba, Bermuda, British Virgin Islands, Cayman Islands, Bonaire, Belize, Turks and Caicos, Maldives, Curacao.
â€œParticipantsâ€ â€“ shall mean each signatory to this document and each signatoryâ€™s Minor Participants, heirs, successors, representatives and assigns.
- Participants and their heirs do hereby execute this Release, Waiver of Liability, Assumption of Risks and Indemnity/Hold Harmless Agreement (the â€œAgreementâ€) for himself/herself/theirself and his/her/their heirs and any of their Minors, guests and invitees and acknowledges the inherent risks involved in the use of the any Swimming Pool, which risks include, but are not limited to bodily injury, sickness, disease or death from using the Swimming Pool. Users also acknowledge and understand that use of the Swimming Pool by Participants, as defined below, is potentially dangerous and that the type of injury or damage described above can occur when using the Swimming Pool. PARTICIPANTS UNDERSTAND THERE MAY OR MAY NOT BE LIFEGUARD ON DUTY DURING THE TIMES USERS WILL BE ALLOWED ACCESS TO SWIMMING POOL UNDER THIS AGREEMENT AS SET FORTH IN PARAGRAPH 2 BELOW AND AGREE TO ASSUME ALL RISKS ASSOCIATED THEREWITH. PARTICIPANTS UNDERSTAND THEY ARE NOT IN THE CUSTODY AND CARE OF LIFEGUARDING CLASSES LLC AND/OR RELEASED PARTIES DURING THE TIMES USERS WILL BE ALLOWED ACCESS TO SWIMMING POOL UNDER THIS AGREEMENT AS SET FORTH IN PARAGRAPH 2 BELOW AND AGREE TO ASSUME ALL RISKS ASSOCIATED THEREWITH.
- The allowed use of the Swimming Pool by Participants, their Minors, their guests and invitees under this Agreement will begin only on the dates and for the times set forth attached hereto and incorporated herein for all purposes.
- In exchange for being permitted to use the services of Lifeguarding Classes LLC and for other good and valuable consideration, the sufficiency of which is hereby acknowledged, the undersigned Participants, for himself/herself/theirself, release and agree not to make or bring any claim of any kind against the Released Parties for: (1) any injury (including death), disease or sickness to Participants, Minors or their guests and invitees related to the use of the services of Lifeguarding Classes LLC; (2) any damage to personal property whether or not caused by the negligence of the Released Parties or not; or (3) any other cause arising out of or related to Participants, Minors or their guests and invitees use of the services of Lifeguarding Classes LLC.
- In consideration for being allowed to use the services of Lifeguarding Classes LLC under this Agreement, and for other good and valuable consideration, the sufficiency of which is hereby acknowledged:
PARTICIPANTS AGREE TO INDEMNIFY AND HOLD THE RELEASED PARTIES HARMLESS FROM LIABILITY OR CLAIMS, DEMANDS, DAMAGES AND COSTS FOR OR ARISING OUT OF: (1) ANY DAMAGE, INJURY, DISEASE, SICKNESS OR DEATH TO PARTICIPANTS OR THEIR MINORS, GUESTS OR INVITEES RELATED TO THE USE OF THE SERICES OF LIFEGUARDING CLASSES LLC; OR (2) ANY DAMAGE OR LOSS TO PERSONAL PROPERTY CAUSED BY OR RELATED TO THE USE OF THE SERVICES OF LIFEGUARDING CLASSES LLC.
PARTICIPANTS UNDERSTAND, ACKNOWLEDGE AND STIPULATE THAT THIS INDEMNITY AGREEMENT INCLUDES ANY SUCH CLAIMS, DEMANDS, DAMAGES AND COSTS ARISING OUT OF NEGLIGENCE ON THE PART OF THE RELEASED PARTIES.
5. Participants acknowledge:
* There may be no lifeguard on duty.
* They are NOT in the custody and care of the Released Parties while utilizing the services of the Released Parties.
* They are utilizing the Swimming Pool at their own risk and agree to assume all risks associated therewith.
6. Participants stipulate and agree that invalidation of any term(s) or provision(s) of this Agreement by judgment or other court order shall not affect any of the other terms or provisions and such other terms and provisions shall remain in full force and effect.
RELEASE OF LIABILITY. The buyer, student, the studentâ€™s heirs, and legal designees agree to hold harmless Lifeguard-Pro, its owners, employees, agents, contractors, and instructors from any and all acts, errors, and omissions committed by the student while serving as a certified Lifeguard, Water Safety Instructor, CPR cardholder, First Aid cardholder, or cardholder of any other Lifeguard-Pro certification. The buyer, student, the studentâ€™s heirs, and legal designees agree to hold harmless Lifeguarding Classes LLC, its owners, employees, agents, contractors, and instructors from any and all acts, errors, and omissions committed by the student while serving as a certified Lifeguard, Water Safety Instructor, CPR cardholder, First Aid cardholder, or cardholder of any other Lifeguard-Pro certification. You understand that completion of this certification course does not guarantee employment with any employer. Employers may re-test prospective Lifeguard employees to whatever standard the employer deems necessary for employment or require Lifeguard employees to possess advanced training or certifications from only specific organizations or individuals. An employerâ€™s refusal to hire the student as a Lifeguard or the studentâ€™s failure to secure employment as a Lifeguard will not entitle the student to any refund of the Lifeguard-Pro course tuition. Lifeguard-Pro and Lifeguarding Classes LLC do not guarantee certification acceptance in any jurisdiction or employment by any employer. Lifeguard-Pro certification does not indicate Lifeguard-Proâ€™s or Lifeguarding Classes LLCâ€™s endorsement of the cardholder (student). Rather, it only signifies that the cardholder (student) has successfully completed the Lifeguard-Pro certification course.
If you purchased a Lifeguard-Pro certification, throughout the entire duration of the certification, the cardholder/certificant must: (1) Continuously improve, maintain and hone his/her certification course knowledge and skills; (2) Conduct himself/herself responsibly and professionally at all times while using this Lifeguard-Pro certification for employment or any other purpose; (3) Learn, obey and enforce all applicable laws, regulations, and rules governing the safe operation of any aquatic facility where he/she will use his/her Lifeguard-Pro certification for employment or other purpose; (4) Immediately cease any employment and immediately obtain the appropriate knowledge and training, if he/she becomes aware that he/she is not adequately prepared to properly respond to all foreseeable emergencies at his/her workplace; (5) Not commence using his/her Lifeguard-Pro certification for employment or other purpose, until he/she has participated in a thorough employer-lead orientation, and a comprehensive employer conducted review of all his/her Lifeguard-Pro certification knowledge and skills, which shall include, but not be limited to, facility orientation, review of all Lifeguard-Pro certification skills and knowledge, practice of emergency response procedures, practice with available emergency response equipment, and emergency response practice with fellow employees and/or staff; (6) Rehearse his/her Lifeguard-Pro certification course knowledge and skills for no less than 4.0 hours of on-site in-service training per month at his/her place of employment where he/she is using his/her Lifeguard-Pro certification as a condition of your employment or service; and, (7) On a monthly basis, review, refresh and practice all skills and knowledge contained in his/her Lifeguard-Pro certification course (including, but not limited to, course textbooks, course exams, course videos, course notes, and course physical skills).
The buyer, student, the studentâ€™s heirs, and legal designees agree to hold harmless Lifeguarding Classes LLC, its owners, employees, agents, contractors, and instructors from any and all acts, errors, and omissions committed by the student while serving as a certified CPR cardholder, First Aid cardholder, CABS cardholder, BLS cardholder or cardholder of any other ASHI certification. You understand that completion of this certification course does not guarantee employment with any employer. Employers may re-test prospective Lifeguard employees to whatever standard the employer deems necessary for employment or require Lifeguard employees to possess advanced training or certifications from only specific organizations or individuals. An employerâ€™s refusal to hire the student as a Lifeguard or the studentâ€™s failure to secure employment as a Lifeguard will not entitle the student to any refund of the Lifeguard-Pro course tuition. Lifeguard-Pro and Lifeguarding Classes LLC do not guarantee certification acceptance in any jurisdiction or employment by any employer.
